Fab CEO Jason Goldberg hinted in an email to his staff today that more layoffs may be on the horizon, as the company pursues becoming "the most loved company in the world." BlackBerry to Gartner: Not Dead Yet!
BlackBerry might be in trouble - ugly, worst-case-scenario trouble - but it's not yet in terminal decline, and the company has taken exception with a report claiming it is.
In a recent note to clients, research outfit Gartner advised those who use BlackBerry's smartphones and its enterprise server solution to develop contingency plans to replace them should the company perish. "All clients should immediately ensure that they have backup mobile data management plans and are at least testing alternative devices," Gartner analyst Ken Dulaney wrote. "Clients have three to six months to build a strategy."
Among Dulaney's suggested courses of action: Discontinue BlackBerry support for any employees except in cases explicitly approved by management; "Move completely away from BlackBerry devices."
Given BlackBerry's sad collapse and its decidedly uncertain future, that's not unreasonable advice. It's hard to imagine anyone who uses the company's products looking at its massive second-quarter loss and its now piddling share of the smartphone market and not concluding that some sort of action needs to be taken.
But BlackBerry feels it's all a bit hysterical. In a statement to AllThingsD, the company dismissed Gartner's recommendation as premature.
"We recognize and respect external parties' opinions on BlackBerry's recent news," a BlackBerry spokesman said. "However, many of the conclusions by Gartner about the potential impact of a sale or other strategic alternatives are purely speculative. BlackBerry is restructuring and pursing strategic alternatives to increase its focus on its core enterprise business. We remain steadfast in our mission to deliver the most secure and powerful mobile management solutions and smartphones to our customers."
That's great to hear, but hardly reassuring. BlackBerry's commitment to its mission and the resuscitation of its business isn't really in question. It's the viability of that business and the market's interest in its products that are concerning.

Oracle Taps Adrian Jones to Head Asian Operations (Read the Memo)
Software giant Oracle named Adrian Jones to head its operations in Asia. The move was announced in an internal email from Oracle president Mark Hurd, obtained by AllThingsD.
If the name sounds familiar, it may be because Jones (pictured) is a former Hewlett-Packard exec who was sued by that company in 2011. HP had alleged that Jones stole trade secrets and shared them with Oracle. The suit dates back to one of the more rancorous periods in the relationship between those companies, and the aftermath of the days when Hurd, who was for five years the CEO of HP, joined Oracle following his surprise resignation in 2010. (That situation, you'll recall, spurred its own legal merry-go-round.)
In a lawsuit filed in the California Superior Court in Santa Clara County, HP had accused Jones of copying sensitive files concerning its strategic and financial plans, plus other information, to a USB drive, and not returning them when he resigned from the company. Among other things, lawyers for HP had sought to examine every electronic device Jones owned, including phones and iPads belonging to his girlfriend.
It later turned out that the copying of the files in question didn't take place at the time that HP originally said it did, but during a period when the computer Jones used was in the hands of HP's corporate security office. Talk about awkward.
Since then, the case has been forgotten. HP was eventually forced to withdraw the case against Jones entirely, according to people familiar with how it all turned out. Neither HP nor Oracle would confirm that, however. Entries in the case-record file on the court's website make vague mentions of a dismissal that occurred on July 30, 2012.
The case against Jones was one of many HP filed during a period when Michael Holston was its general counsel. Remembered as a key aide to Hurd during the years he was running HP, Holston remained HP's general counsel during the 11-month tenure of former CEO L o Apotheker, but was among the first members of HP's executive council to leave the company after Meg Whitman became CEO.

Has Apple Hit a Wall in China?
When Apple reported earnings for its second fiscal quarter back in April, CEO Tim Cook touted the period as the company's "best quarter ever in Greater China," and celebrated the eight percent growth it had seen in the region. Three months later, Apple's trajectory in China has taken a decidedly different turn, and Cook's upbeat proclamations about the company's future in the country have morphed into stalwart reassurances.
In Apple's latest quarter, revenue from Greater China - which includes Hong Kong and Taiwan - fell 14 percent year over year to $4.6 billion. That's a 43 percent decline from the previous quarter, the one Cook touted as Apple's best ever.
What happened?
That's not entirely clear. Attempting to explain the decline during an earnings call with analysts this week, Cook said that the drop Apple reported in Greater China appears worse than it is because the company better managed its channel inventory. "Our sell-through in China was only down four percent from the year-ago quarter, when you normalize for channel inventory," he said. He also noted that sell-through in mainland China for the period actually rose five percent year over year. Unfortunately, sell-through in Hong Kong fell by about 20 percent, weighing down sales for the entire region. Why? Said Cook, "It's not totally clear exactly what occurred."
That may be so, but the argument could be made that Apple's recent performance in Greater China would have been much improved by two things: A distribution deal with China Mobile, China's largest carrier, and a lower-priced iPhone that will appeal to the less-wealthy side of its massive subscriber base, which at last count numbers more than 700 million.
As BTIG analyst Walter Piecyk told AllThingsD, "Apple needs to deliver a low-priced 2.6 GHz TD-LTE phone to China Mobile, and all this unnecessary anguish can be resolved."
Perhaps, though, Apple needs to continue to up its game in Greater China in other ways, as well - expanding its retail-store footprint and dramatically increasing iPhone availability in the region. Which is exactly what Cook said the company is doing.
"We're going to double the number of retail stores in China for the next two years," Cook said. "We're continuing to lift iPhone point of sales and iPad sales, both of which are currently lower than where we would want them or need them today. But we're doing that very cautiously with what we want to do with great quality. And so I continue to believe that in the arc of time here, China is a huge opportunity for Apple."

Fast Car: Uber Funding Auction Could Reach a $3.5B Valuation
Uber, the ride-logistics startup, could be valued at up to $3.5 billion in a new funding round led by TPG Capital, said multiple sources close to the discussions, which are ongoing but advanced. We had first reported that Uber was seeking the round in June.
In the past few days, we've heard a continuous stream of rumors and reports about the funding auction for the high-profile startup, with uber-high valuations floated. That seems to be the case for the deal as it is now conceived, as the amount that Uber is valued at has risen over the last month.
Still, no deal is done as yet, said sources, warning that any terms could change.
In recent weeks, Uber CEO Travis Kalanick hasn't been particularly discreet about his company's fundraising efforts, which sources said could bring the company more than $100 million in investment funds for use in expansion of its offerings.
Sources said that TPG, the large private equity firm, is aware of the perception of such a lofty valuation and has been endeavoring to negotiate more favorable terms for its investment.
A year and a half ago, Uber raised $37.5 million in 2011 from investors including Menlo Ventures, Benchmark Capital and Goldman Sachs. At the time, the company was valued at $330 million.
The ensuing months have been fruitful. Sources said Uber is now on track to bring in about $125 million in total revenue this year, much higher than had been projected, and that number is growing quickly.
In addition to TPG, Google Ventures could also be one of its new investors, sources said.
It must be noted that, when asked a direct question at the Fortune Brainstorm conference in Aspen this week about new Uber funding at a $2.5 billion valuation that Airbnb reportedly has, Kalanick appeared to deny the higher price, but was also not specific.
"So, the party line is that we are not commenting on fundraising discussions we may or may not be having," said Kalanick, who often playfully parses his words. "You know, there are probably one or two folks we're talking to who we've signed NDAs with who are particularly loose with information, but that information is not correct."
Reached for comment late Wednesday, an Uber representative referred us back to Kalanick's onstage remarks, but declined to elaborate or answer further questions.
Uber now operates in 35 cities around the world, and Kalanick told us less than a month ago that revenue is growing 18 percent each month. The company now has some 320 employees, and said Wednesday that it would launch its service in Silicon Valley. In recent months, Uber hired CTO Thuan Pham, formerly of VMware, and set up international operations in the Netherlands.
After starting as a limo-hailing service and expanding to all sorts of vehicles, Uber has also extended into new areas beyond moving people around - such as stunts to deliver ice cream. "We like to think of Uber as the cross between lifestyle and logistics, where lifestyle is what you want and logistics is how you get it there," Kalanick has said.
Other car services have also raised money recently. Lyft recently raised $60 million, bringing its total to $83 million.
Another peer-to-peer ride-sharing service, Sidecar, raised $10 million from Lightspeed Venture Partners and Google Ventures.

This nifty Japanese umbrella can stand on its own
There are lots of reasons not to like rainy days, but umbrellas have to be near the top of the list. They constantly break and they're awfully unwieldy. Japanese designer Oki Sato is doing his part to improve the humble umbrella, though - his Stay-brella won't fall down when you lean it on the wall. You can even stand it upright by the handle or hang it off of a table thanks to the two prongs the stick out at the end. Apple releases web tool to deregister phone numbers from iMessage
Apple has quietly released a new tool to make switching between iOS and other smartphones a bit easier. The new web tool lets you instantly deregister your phone number from Apple's iMessage system. The site, first spotted by a poster on Reddit, should solve the problem of disappearing text messages.
Many former iPhone users have reported for years that they were not receiving text messages from their friends. The issue stemmed from Apple continuing to route texts through iMessage even after users had moved on to other devices. Twitter to Add Parental Controls
Twitter has added a way to flag links within tweets as "possibly sensitive." The company announced late Thursday that there is a new field in the Twitter streaming API that will show up whenever a tweet contains a link, giving Twitter users the option to be warned before they click links that might be too sensitive for the workplace, or for tender ears and eyes.
The new feature is not functional yet, but Twitter was informing developers that it was just added and is now in the testing phase. According to Twitter representative Taylor Singletary, "In the future, we'll have a family of additional API methods & fields for handling end-user 'media settings' and possibly sensitive content."
According to Gizmodo, Twitter reps say the company doesn't intend to censor material. But according to Twitter's media policy document, the company will "remove media that might be considered sensitive such as nudity, violence, or medical procedures."
In the announcement, Singletary encouraged those who were curious about how this capability would ultimately be used to read that media policy document.
To us, this seems like a feature that's long overdue, giving users the ability to control the kind of content they or their children are exposed to, letting them use Twitter without fear of being unpleasantly surprised when they click on an inappropriate link.
Gmail v2.3.5 for Android adds label-specific ringtones and sync priority mail only options
If you love Gmail and need to access it on the go you probably already know that Google's Android platform is the best way to access it, and with v2.3.5 that just hit it's getting even better. The top two new features this time around include the ability to sync only priority messages (saving battery life and keeping unimportant messages at bay) and the ability to individually set notifications and ringtones for any of the labels in your inbox. The Android Market website is still showing version 2.3.4.1, but we successfully upgraded via the Market on our devices. Also new are features like remembering "Show Pictures" for specific senders, a toggle for sticky message actions in all orientations as well as improved overall performance and TalkBack screen reader support.

Virginia Courts Rule Police Cannot Force Users to Disclose Passcode, but Can Force You to use Touch ID to Unlock your iPhone or iPad
In a Virgina Beach Circuit Court ruling, a criminal defended will be required to use his fingerprint to unlock his iOS device, even though he does not have to reveal his passcode so that police can search the contents.
This is a very interesting case and sets precedence for future rulings. A person's passcode is considered knowledge, therefore he cannot be forced to reveal it under the law. The Fifth Amendment prohibits forced self-incrimination. However, the Virginia ruling considers Touch ID to be more inline with giving a DNA sample, a handwriting sample, or a physical key.
If you think of Touch ID as a form of fingerprinting, then the ruling makes sense. However, if you think of Touch ID as a form of personal encryption, the ruling violates the Fifth Amendment.
Wired wrote an interesting piece on the subject more than a year ago, when Touch ID was first introduced. The article's author, attorney Marcia Hofmann, notes that the Fifth Amendment may not apply when it comes to biometric-based fingerprint compared to memory-based passwords. The Fifth Amendment protects people from being forced to give a testimonial that might incriminate them.
"A communication is "testimonial" only when it reveals the contents of your mind. We can't invoke the privilege against self-incrimination to prevent the government from collecting biometrics like fingerprints, DNA samples, or voice exemplars. Why? Because the courts have decided that this evidence doesn't reveal anything you know. It's not testimonial."
This is the first in what will, most likely, become a common ruling. It is likely that, in a future update, Apple will implement the ability to have both biometric fingerprint scanning and password verification for true two-step authentication on iOS devices.
